CONFIDENTIALITY

 

  • The coaching relationship, as well as all information (documented or verbal) that the Client shares with  the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the IANLP Code of Ethics.

 

  • The Coach acknowledges and respects the importance of confidentiality in the Coach-Client relationship. While it may not be legally classified as confidential in the same manner as medical and legal professions, the Coach is committed to maintaining a high standard of discretion and will not disclose any information shared by the Client without explicit consent, except as required by law.

 

  • All information and or documentation (in whatever form) disclosed by the Client to enable the Coach undertake the Services (and shall include but shall not be limited to Client customer information of whatever kind); and any other information that should reasonably be recognized as Confidential Information of either Party. Confidential Information need not be novel, unique, patentable, copyrightable or constitute a trade secret in order to be designated Confidential Information.

 

  • The Coach agrees not to disclose any Confidential information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent.

 

  • Confidential Information does not include information that:

    • Was in the Coach’s possession prior to it being furnished by the Client;

 

  • Is generally known to the public or in the Client’s industry;

 

  • Is obtained by the Coach from a third party, without breach of any obligation to the Client;

 

  • Is independently developed by the Coach without use of or reference to the Client’s confidential information;

 

  • The Coach is required by statute or by court order to disclose;

 

  • Information that is disclosed to the Coach and as a result of such disclosure the Coach

    • reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others;

    • Involves illegal activity.

 

  • The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

 

  • The Coach undertakes to adopt appropriate technical measures having regard to the risks inherent in the services being provided, and, having regard to the risks inherent of coming into possession or knowledge of Personal Data of persons enjoying the coaching services i. The Coach therefore undertakes to prevent any unauthorized person from having access to Personal Data, and especially:

    • Unauthorized reading, copying, alteration or removal of data;

    • Unauthorized disclosure, use, alteration or erasure or illegal transmission or publication of Personal Data.
